01About these terms

These Terms of Service (“Terms”) form a binding agreement between you and Devs In Exile Studio (“we”, “us”) and govern your use of all games, applications and related services published by us, including updates and any content within them (collectively, the “Services”). Our products differ in features: some display advertising, some offer in-app purchases, some include online features and some work entirely offline — these Terms apply to all of them, and an individual game may additionally present its own in-app terms that supplement these Terms.

By downloading, installing, accessing or using any of the Services you agree to these Terms. If you do not agree, do not use the Services. These Terms are complemented by our Privacy Policy, which explains how we handle personal data.

02Eligibility

You must be at least 13 years old (or the age of digital consent in your country, if higher) to use the Services. If you are a minor, you may use the Services only with the knowledge and consent of a parent or legal guardian, who accepts these Terms on your behalf. Where purchases are possible, the account holder responsible for the payment method (for example, a family account owner) must authorize them. Some of our games may carry age or content ratings on their store listing; those ratings are part of these Terms.

03License to use

The Services are licensed, not sold, to you. Subject to these Terms and to the policies of the store from which you obtained the game, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use each game on devices you own or control, solely for your personal, non-commercial entertainment. This license is conditioned on your compliance with these Terms. You may not: copy the game except as permitted by applicable law; sell, rent, lease, sublicense or distribute it; use it to provide services to third parties; or circumvent technical protection measures.

04Purchases and virtual items

Some games offer in-app purchases (for example, cosmetic items, hints or ad removal). Payments are processed exclusively by Google Play Billing; we never receive your payment card details. Virtual items constitute a limited, non-transferable, non-refundable (except as required by law) license to use a feature within the relevant game; they have no real-world monetary value and cannot be exchanged for money, goods or services.

The purchase of virtual items and any refund requests are additionally governed by Google’s payment and refund policies. If a purchase is refunded, revoked or charged back, we may remove the corresponding items or restrict the associated features. We may manage, balance, modify or remove virtual items at any time to keep games fair and functional, with reasonable efforts to avoid harming legitimate player progress.

05Advertising

Some of the Services are supported by advertising and may display ads provided by third parties, primarily through Google AdMob. Where personalized advertising is offered, it is subject to your consent where required by law; you can change your choices via the in-game prompts or your device settings. Advertising is part of the Services; the presentation and availability of ads may change as games evolve. For details on the data involved, see our Privacy Policy. We are not responsible for the content of third-party advertisements, and any dealings you have with advertisers are solely between you and them.

06Acceptable use

You agree not to:

• use the Services for any unlawful purpose or in violation of these Terms;
• cheat, exploit bugs or glitches outside of reporting them, use unauthorized third-party software, mods, automation or memory editors to gain an advantage;
• interfere with or disrupt the Services, our servers or the servers of our providers;
• harass, threaten or harm other players, or upload unlawful, infringing or malicious content where the Services allow user input;
• reverse engineer the Services except where such restriction is prohibited by applicable law;
• collect data from the Services with automated tools, or resell or commercially exploit any part of the Services.

07User-generated content

Where a game allows you to create or submit content (such as nicknames, level solutions, screenshots or messages), you retain ownership of your content. By submitting it, you grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, display and modify that content solely as needed to operate and improve the relevant game. You are solely responsible for the content you submit and confirm you have the rights to it. We may remove content that violates these Terms, and we may (but are not obligated to) moderate, screen or monitor user content.

08Intellectual property

The Services, including all games, code, graphics, animations, sounds, music, text, trademarks and design, are owned by Devs In Exile Studio or its licensors and are protected by intellectual property laws. Some assets are used under license from third parties or from the public domain. Portions of our content may be created with the assistance of AI-based tools as described in our Privacy Policy; all such content is used in accordance with the applicable tool terms. Except for the license expressly granted in these Terms, no rights are transferred to you.

09Third-party services

The Services rely on third-party platforms and SDKs (for example Google Play Services, Google Play Billing, AdMob and, in some games, Firebase). Their availability and behavior are outside our control; your use of them is governed by their own terms. We are not liable for third-party services, third-party advertisements or content accessible through links within the Services.

10Updates and availability

We may patch, update, modify, suspend or discontinue any part of the Services at any time. Where a feature (such as online services or cloud saves) depends on third-party infrastructure or on continued interest in a game, it may not be available forever; we will act reasonably when shutting anything down. You are responsible for obtaining updates, and certain updates may be required for continued use of a game.

11Disclaimer of warranties

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not warrant that the Services will be compatible with every device or free of bugs or that defects will be corrected. Nothing in these Terms excludes warranties that cannot be excluded under applicable law — including statutory consumer rights in relation to digital content, which remain unaffected.

12Limitation of liability

To the maximum extent permitted by applicable law, Devs In Exile Studio and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits, goodwill or device functionality, arising from or related to your use of (or inability to use) the Services. Our total aggregate liability for all claims relating to the Services shall not exceed the amount you actually paid us for the relevant game in the twelve months preceding the claim, or fifty euros (or its equivalent) if you made no payments. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by applicable law.

13Indemnification

You agree to indemnify and hold harmless Devs In Exile Studio from any third-party claims, damages and reasonable costs arising from your breach of these Terms, your violation of any law or third-party right, or content you submit where the Services allow user content.

14Termination

You may stop using the Services at any time and delete the games from your devices. We may suspend or terminate your access to a game or its online features, with or without notice, if you materially breach these Terms, if we are required to do so by law, or where reasonably necessary to protect other players or our services. Sections 04, 08, 11, 12, 13 and 15 survive any termination, as do any other provisions which by their nature should survive.

15Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. Before filing a claim, please contact us — most issues can be resolved by email. You and we agree to attempt good-faith resolution of any dispute. Consumers retain the right to bring claims in their country of residence and to rely on mandatory consumer-protection rules of that country where applicable. Claims must be brought individually; to the maximum extent permitted by law, class actions are excluded.

16Changes to these terms

We may update these Terms from time to time, for example when features of our games change. The current version is always posted on this page with an updated “Last updated” date, and material changes will be announced on this page or within the affected game. Changes apply prospectively; your continued use of the Services after changes take effect means you accept the updated Terms. If you do not agree with the updated Terms, you should discontinue use of the relevant game.

If a provision of these Terms is found unenforceable, the remaining provisions stay in force, and the unenforceable provision will be modified to the minimum extent necessary. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
